Welcome to Code Love Excavation. By using our services, renting equipment, or submitting a request for a quote, you agree to the following terms and conditions. Please read carefully.
1. DEFINITIONS
Authorized Individuals: Individuals allowed by Customer to use our equipment or services, who must be at least 18 years old, properly trained, and not under the influence of drugs, alcohol, or otherwise impaired.
Customer: The person or entity requesting services or renting equipment, including their representatives, agents, employees, or anyone signing on their behalf.
Equipment: All machinery, tools, vehicles, or accessories rented or provided by Code Love Excavation, including replacements or additions.
Incident: Any accident, damage, theft, injury, or loss related to equipment or services.
Rental Period: The period starting when equipment is delivered to Customer and ending when returned or collected by Code Love Excavation.
Site Address: Location where equipment will be used or services performed.
RPP (Rental Protection Plan): Optional plan limiting Customer liability for equipment damage or loss.
2. ACCEPTANCE OF TERMS
By requesting or using our services, submitting a quote, or taking possession of any equipment, Customer accepts these Terms & Conditions. All rentals are considered leases, and equipment remains the property of Code Love Excavation at all times.
3. PERMITTED USE
Customer agrees to:
Inspect equipment before use and ensure it is in good condition.
Operate equipment according to manufacturer instructions and safety guidelines.
Ensure only Authorized Individuals use equipment.
Notify Code Love Excavation immediately of any damage, theft, or safety issues.
Keep equipment in a secure location and comply with all applicable laws, permits, and safety regulations.
4. PROHIBITED USE
Customer shall not:
Alter, remove, or cover any decals or safety features.
Assign or transfer rental rights to others without written consent.
Use equipment illegally, negligently, or for unauthorized purposes.
Allow untrained individuals to operate equipment.
5. MAINTENANCE & REPAIRS
Customer is responsible for routine maintenance (fuel, oil, cleaning, lubrication).
Repairs beyond ordinary wear and tear must be performed by Code Love Excavation or approved service providers.
Customer is liable for damage exceeding ordinary wear and tear, theft, or loss of equipment.
6. CUSTOMER LIABILITY
During the rental period, Customer assumes all risks related to equipment possession, use, transport, or operation. Customer is responsible for injury, property damage, theft, or loss.
7. WARRANTIES
All equipment and services are provided “as is” without warranties of any kind, expressed or implied. Code Love Excavation is not liable for incidental, special, or consequential damages.
8. INDEMNIFICATION
Customer agrees to indemnify and hold Code Love Excavation harmless from any claims, damages, or losses arising from the use or operation of equipment or services, including those caused by authorized or unauthorized users.
9. INSURANCE
Customers using equipment or services are responsible for maintaining adequate insurance coverage.
Insurance should cover liability, property damage, workers’ compensation, and vehicles used in connection with the equipment.
10. RENTAL PROTECTION PLAN (RPP)
If offered, RPP limits liability for accidental damage or loss of equipment. Exclusions apply (e.g., intentional misuse, natural disasters). RPP is optional and not insurance.
11. RENTAL RATES & CHARGES
Rental rates are based on estimated use and may include delivery, pickup, fuel, or other applicable fees.
Customer is responsible for taxes, permits, and additional service charges.
Late returns will incur additional rental fees until equipment is returned in proper condition.
12. PAYMENT TERMS
Payment is due in full upon service or equipment rental unless otherwise agreed.
Accepted methods: credit card, check, or approved commercial credit account.
Late payments may incur interest and collection fees.
13. RETURN OF EQUIPMENT
Equipment must be returned in the same condition, less ordinary wear and tear, at the end of the rental period.
Failure to return equipment promptly may result in additional charges and liability for damages.
14. PURCHASES
Items purchased from Code Love Excavation are sold “as is,” with title retained until full payment is received.
15. DEFAULT & REPOSSESSION
Customer will be in default if:
Payment is not made on time
Equipment is misused or not insured
Equipment is not returned upon request
Code Love Excavation reserves the right to repossess equipment without prior notice in the event of default.
16. LIMITATION OF LIABILITY
Code Love Excavation’s liability shall not exceed the total amount paid by the Customer for the relevant equipment or service.
17. FORCE MAJEURE
Code Love Excavation is not liable for delays or failures caused by events beyond our control, including natural disasters, pandemics, strikes, or government orders.
18. GOVERNING LAW
These Terms & Conditions are governed by the laws of [Your State], without regard to conflict of law principles.
19. MODIFICATIONS
Code Love Excavation may update these Terms & Conditions at any time. Continued use of services constitutes acceptance of the updated terms.
